Welcome to SimpleMint Design Co. The terms "we", "us" and "our" refer to SimpleMint Design Co. SimpleMint Design Co. operates this store and website, including all related information, content, features, tools, products and services, to provide you, the customer, with a curated shopping experience (the "Services"). SimpleMint Design Co. is powered by Shopify, which enables us to provide the Services to you.

We have made every effort to provide an accurate representation of our products and services. However, colours or product appearance may differ from how they appear on your screen due to your device type, settings, and configuration.

We do not warrant that the appearance or quality of any products or services purchased by you will meet your expectations or be the same as depicted in our online store.

All product descriptions are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time.

Digital products. All products sold by SimpleMint Design Co. are digital downloads delivered as Google Sheets files. No physical product will be shipped. Delivery is made via a "Make a Copy" link provided in a PDF sent to you after purchase. Because digital products are delivered immediately upon purchase, all sales are final. Please review product descriptions carefully before purchasing.

Section 3 - Orders

When you place an order, you are making an offer to purchase. SimpleMint Design Co. reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until SimpleMint Design Co. confirms acceptance. We must receive and process your payment before your order is accepted.

Please review your order carefully before submitting. SimpleMint Design Co. may be unable to accommodate cancellation requests after an order is accepted. In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the email address provided at the time the order was made.

You represent and warrant that your purchases are for your own personal use and not for commercial resale or redistribution.

Section 4 - Prices and billing

Prices, discounts and promotions are subject to change without notice. The price charged for a product will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Unless otherwise stated, posted prices do not include applicable taxes.

You agree to provide current, complete and accurate purchase and payment information for all purchases. You agree to promptly update your account information, including your email address, so that we can complete your transactions and contact you as needed.

You represent and warrant that: (i) the payment information you provide is true, correct and complete; (ii) you are authorized to use the payment method provided; and (iii) charges incurred by you will be honoured by your payment provider.

Section 5 - Delivery

All products are delivered digitally. After your purchase is confirmed, you will receive a delivery PDF containing a secure link to access your product. This link allows you to make a private copy of the Google Sheets file directly to your own Google Drive.

SimpleMint Design Co. is not responsible for delays caused by incorrect email addresses provided at checkout, email delivery failures caused by your email provider, or failure to access Google Drive. If you experience a delivery issue, contact us at simplemintdesignco@gmail.com.

Section 6 - Intellectual property

All content, materials, and products offered through the Services, including but not limited to text, graphics, product designs, Google Sheets templates, and accompanying guides, are owned by SimpleMint Design Co. and are protected by Canadian and international copyright and intellectual property law.

These Terms permit you to use purchased products for your own personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, resell, sublicense, share, or publicly display any product or material from the Services without our prior written consent.

SimpleMint Design Co.'s name, logo, product names, designs, and tagline are trademarks of SimpleMint Design Co. You must not use such trademarks without prior written permission.

Section 7 - Optional tools

You may be provided with access to tools offered by third parties as part of the Services, which we neither monitor nor control.

We provide access to such tools "as is" and "as available" without any warranties or representations of any kind. We have no liability arising from your use of optional third-party tools. Any use of such tools is entirely at your own risk.

Section 8 - Third-party links

The Services may contain links to websites operated by third parties. We are not responsible for examining or evaluating the content or accuracy of any third-party websites you choose to access. If you leave the Services to access third-party sites, you do so at your own risk.

14.4 Agents must: (i) identify that the request is from an Agent and disclose the name of the Agent in all HTTP/HTTPS requests; (ii) not conceal or obfuscate that any access or interactions are from an Agent; (iii) respond truthfully to any question seeking to determine if interactions are coming from a human or a computer; and (iv) not circumvent any measure intended to block, limit, or control whether and how Agents access, use, or interact with the Services.

You agree to indemnify, defend and hold harmless SimpleMint Design Co., Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities or claims, including reasonable legal fees, payable to any third party due to or arising out of: (1) your breach of these Terms of Service; (2) your violation of any law or the rights of a third party; or (3) your access to and use of the Services.

You and SimpleMint Design Co. consent to the exclusive jurisdiction of the courts of Alberta for the resolution of any disputes arising out of or relating to these Terms or the Services.
